Dhave, Justice A.K. Sikri, Justice R.K. Agarwal, Justice A.K. Goyal, Justice Bhanumati gave a clear ruling on how Education Institutions should function. They reiterated that Educational Institutions should run on non Commercial methods. Setting up an education institute should not be on Profiteering basis. Bench also recommended State Govts to set up regulatory body to monitor merit based entrances, Financial Transparency, and curtailing any wrong practices by Education Institutes. Though Educational sector comes under professional service but as per 19(1)(g) rule, this sector is considered as primary right to citizen. Hence, education sector will come with lot of considerations even though it is considered as a working profession. This profession is very sacred sector where Profiteering, Commercialization should not be encouraged. Hence, Capitation Fee should not be encouraged. Entrance should be on merit basis and not as per the will of educational institutions. Entrance criteria should satisfy 3 conditions : Transparency, Unbiased, Non Commercialization clarifies the Supreme Court bench. These institutes should not pressurise parents, students with unjustifiable demands.
