Addition of Spouse name in Conveyance Deed

Hi,

I was reading the Conveyance Deed Process document and found following line in that:

"It seems that Delhi Development Authority (DDA) as per their rules and regulations makes allotment by default only in the joint names of Husband and Wife if the applicant is married even though the application and subsequent draw was made in single name."


Point is I got married after applying for DDA 2010 housing scheme and currently my wife's name is not in the CD, which I got.

So question is do I need to go to DDA office and add her name or can I get it done when I will to to DDA office for the stamping of CD by just telling them this thing and then proceed with payment of stamp duty part?

Also, do I need to take some documentary proof for the same and which proofs will be valid ?

Hi Raman,

Please visit DDA with your marriage certificate, wife's photo and id/address proof(not mandatory but better to carry), they will add it. just 5 min. job.
and than submit CD with changes.

You will surely save 1% stamp duty.

Similar is the case with me...only the thing is i dont have a marraige cert...how do i get it?....any othr proof is eliguble like wedding album?

I guess there is way out ...visit DDA they will suggest (some kind of affidavit on stamp...)

I have my wife's name in the conveyance deed but it is not against
"joint name" column.
Is including wife's name equivalent to joint ownership of the flat/property?

To All,
If you are married and mentioned it in the application form of dda
2010 then in conveyance deed wife name would be added by default.
secondly if some one got married after the allotment has to add his
wife name in conveyance deed.
it would be always advisable to add wife name in conveyance deed as
1. 1% saving on stamp charges
2. Registry could be used in the various govt. organizations for
miscell purposes.
3. In case of mis-happening transfer of property easily done to either
cases (bhagwan naa kare)
4. as per Delhi Government wife name in conveyance deed/Registry is
compulsory.
affidavits as mentioned by DDA in DL are enough for wife recognition.
one thing more i got Objection letter for wife's documents
They asked ID and Address proof so don't forget to attach these docs
before submitting possession set
desirable docs are:
Voter ID card/ration Card/Aadhar Card/passport/Driving License

As it happens, all my wife's address proof are of her native place and not where we stay currently (Gurgaon).
Will it matter if her address proof is not of Gurgaon??

Thanks Naren for the info , one question which other people have also asked on this forum,

 Does including spouse name in CD means joint ownership of property ? I am asking this because in case spouse buys second house he/she will have to show rental income on one of the houses even though none is rented. As per IT laws if you have two houses in your name, you must pay tax on rental income of one of those even though none is rented out.

You must pay tax if the second house is actually put on rent, but if
it is not you don't need to pay any tax.

Are we requried to paste Joint Photographs or Separate Photographs for
Husband and Wife on the conveyance deed papers ?

May sound like a stupid question but ...We only have 1 box ...So if we
need to paste separate photos ..we have to Keep in mind the space
availaible

Could anyone who has already completed this process please share your
exprience ?

Hi Rajat/Rohit and all,
there is one box for photo..fine..this is for signing conveyance deed
papers NOT EXECUTION,
when physical possession has been taken by owner then conveyance deed
executed and it would be signed by DDA official and owner of property
in the presence of Two witness and joint photo has been taken with CAM
and printed and attached with conveyance deed for registry. after that
you would be legal owner of that property.
merely signing conveyance deed doesn't make you legal owner...so
wait.for good time..

Hi

I have submitted the possession set at the end of December 2011. But i recently got married in March, 2012.

I also received one objection letter in Feb 2012 which I already responded, again before marriage.

So in my case please suggest what I should do?

If anyone has the same case, then please put forward your suggestions.

Hi Naren.

I have my husband's name in the conveyance deed but it is not against
"joint name" column.but under spouse name column

Does it that mean the registry will be on both our names? or do i need to get his name added under joint name for adding his name in the registry.

Also to be eligible for taking a joint loan from SBI does his name also required to be on the property registry?

I have forgot to mention my spouse name in the very first application so i have received the CD without my spouce name.
today i went to DDA office for the correction but they have denied to make any changes now. I have met with the director housing and he told me that they will try to add the spouse name but not sure.
 
Is any one has made the similar mistake :) or gone through such process with DDA. its really pethatic and frustating.
 
 Please advise the way forward.

Hi All,

I read this thread and still have confusion about what to do in case
when spouse name is not in "Joint Name" on Conveyance Deed but is
mentioned in "Spouse" section (barring case where applicant got
married after application)

Just to summarize
(1) Anupam suggested to visit the DDA office with marriage related
documents and DDA can add it.
(2) Sunil tried it by visiting DDA office but DDA officials denied to
do it.
(3) Naren mentioned that Delhi Govt made wife's name in Conveyance
Deed/Registration compulsory.

Can anyone help on what to do in this case by prior experience with
DDA? How did allotees who received DL earlier last year and completed
this process resolved this?

1. Afadevit from both husband/wife on 10 Rs stamp paper..with additional Rs. 5 stamp...(format is already in DL..)
2. one ID proof (passport, voter id of spouse)
3. Tspecimen signature along with photo of both attested by gaz. officer or notary..
4. Marriage certificate...if you don't have like in my case marriage card will serve the purpose..

They will find add the spouse name manually and Asst. director will put the signature and stamp on the same...

Hi Raman,

As per dda process they will put spouse name in CD if person is married.. So as per process i feel its mandatory and we have to provide the correct updated information to DDA to keep our self on safe side legally...

Thanks Harmesh for outlining the procedure. Do you know if the
procedure is same if I already have my brother(unmarried) as joint
allotte? I got married last year and I have been getting different
answers on whether on not I should add my wife. I plan to visit DDA
next week and will take similar documents but just wondering if they
require some kind of NoC from my brother or something else.

my  younger   son  sahil mittal is allotted  HIG flat in yamuna block d-6 vasant kunj.   can  i add name of  my elder son in
CD paper as co applicant. so that i get 1% rebate in stamp duty. & tell me what is the procedure.

Went to DDA Vikas Sadan today for addition of spouse name in CD. They told me to submit the documents ( As suggested by you below) at Counter no 4 and come back tomorrow for CD correction.

 

How did you got everything done in one day ?

Hi Rajan/Pankaj,

I got a pass to meet LIG Asst Director around 10:30AM..One dda lady forgot her name verified all my docs..there was no rush in morning and I request them to do on same day as i told them that i had come from Meerut UP...and she asked me to meet Asst director in public hearing to sign on my file...nd in public hearing Asst director signed on my file..nd then she signed and one more person sitting there signed and handover the CD to me..

Pankaj,

You cant do boh in one day. Public meetings time is 2:30 - 5:20 pm for
addition of spouse name and CD stamping is 10 - 1 PM.

Joint photograh on CD is fine. Please bear in mind simple manual
addition by officials is not acceptable by Stamping officials.

I got a new CD issued after their refusal.

sorry its there in the CD document. Quoting here "In case of married

Hi Rajan

Who did you contact to get your wife's name added? When I met Dep.
Director/DDA officials on 3rd floor, she told me to submit affidavits
and marriage certificate on counter 4 on ground floor along with
application for addition of name.

I did that on 11th May, and was expecting they will send the deed by
speedpost or I will visit them this Thursday. Not sure if I am on
right track here.

In my case DDA added spouse name manually and Asst director put stamp and sign... i have submitted the CD on 18/05 without any probs..hope in future i will not face any probs..

You were lucky to get everything done in one day. For me it took more than couple of visit to do the same. The issue was raised by CD authority as Asst directory manually added spouse name but refused to stamp and sign the same stating it is not required.

 

As you have sumitted CD there should not be any issues.

Might sound strange to you but in my case I myself also submitted documents at Counter no – 4 and was asked to see Asst director during public meetings hours. On the day I met Asst director he insisted that I should have not submitted it at the counter and directly deposited the same with him.

 

But on my insistence he did add the name of my spouse on CD but refused to stamp and sign. The next day CD guys raised objection ; to which I met Deputy director and she helped me in getting a new CD issued then and there.

Thanks Rajan for the detailed explanation. Just one more question. How
did you find the documents you had submitted at DDA counter? Were they
in your file or you had to get them from some where else?

I think Harmesh has LIG flat and you have HIG and so both are handled
by different departments. And there is no set procedure by DDA. They
do as they want.

Let me go to DDA this Thursday and try to get CD changed.

Aarul,

I was asked to submit another application and attach marriage certificate
and id proof along with the same. For affidavits he said they would be
included in the file once they come upstairs from counter no 4 in due time.

My wife name has not been included in the Joint's nm column of Conveyance deed paper but her name has appeared in the Spouse column of conveyance deed. Kindly clarify if i still have to get her name added as joint allotee to get benifit of paying 5% stamp duty instead of 6 % or is it already understood to be done. Thanx

I have made 2 trips alredy to dda frm ggn and hv not been able to get spouse name added.. 2 paid leaves wasted..dda askin for more docs and saying it will take 4-5 days for cd to get cahnged after giving all docs... One babu shamelessly said today ...dekho flat lena hai to aana hi padega... Will go again on monday now...pretty disapointd

Finally got the CD submitted today.

It was a long process for me as my brother (unmarried) was joint
allottee and I got married after the draw. Hence conveyance deed
didn't have my wife's name.

1. Went to DDA office on May 10, 2012. Talked to guys there and they
asked me to get affidavit's, marriage certificate, application and
submit at counter 4.
2. On May 11, 2012, I submitted all documents.
3. On May 24, 2012, went to DDA office to enquire about the status. I
saw my file moving and was about to go to Asst. Director for approval.
I pushed a little and got approval from asst. director and took the
file to Mr. Gaur. He just added the name my pen and signed it. I asked
him to stamp it as well but he refused and said that if stamping
office says anything get it written by them. He said the sign is same
as that in demand letter and it should work. So conveyance deed
changed with signature but no stamp.
4. On May 28, 2012, went to stamping office and the guy refused to
accept the conveyance deed and asked to get it stamped. He said "how
would I know ki kiske sign hain". He showed my a photocopy of
conveyance deed where asst. director of LIG had signed. I went to
welcome center to get a pass made. I told them that this is the
problem I am facing and they gave me a pass. I went to 3rd floor
(HIG). Mr. Gaur was still not in office. There is this another guy
(can't remember his name) who sits in the back (white hair, leftmost
corner). I asked him to help and he sent me to the peon's desk who
moves file to get it stamped. The peon stamped it without raising any
issue.
5. Submitted the CD, got the challan.
6. The bank required four copies (4 + 1 original) of challan instead
of three as written in the document on the DDA-2010 website.
7. They said it will take half hour to get final receipts. I got the
lien letters for SBI loan submitted during that time.
8. returned to bank, they gave me receipt. I took its copies and
deposited it in stamp office.
9. I got a date of 6th June but the person there told me to come back
after 10 days (ie 16th June) as it will take time for verification.
10. I plan to anyway go there not before 21st June.

And next is getting sbi loan disbursed this Friday. Hope everything
goes well there too. And then the possession set.

Thanks Aarul for the detailed mail. As per your description the correction was made manually in CD by Mr. Gaur which was subsequently signed and stamped.

Have you made sure that they have updated the same in their systems/records as well and it will not raise any unnecessary objections during possession ? If yes, Please let me know how it was done because I am also facing a similar issue where my CD was corrected manually and my name was deleted from Joint name column (since my wife applied as single applicant and my name was put in Join name column by mistake), but I am not sure if same has been updated in their records as website still shows me as joint allottee.

I think if you have not submitted any documents regarding this than it
won't be updated. Just submit an application stating what you want to
do and with all the necessary documentation to support your case, at
counter no. 4.

As far as I have understood DDA working so far, documents submitted at
the counter take at least 15 days to go through asst. director's
approval. You can visit DDA then to find out about your request and
status.

And probably online updation will take even more time.

I have finally got my CD altered. It has now my wife's name.
Tomorrow I plan to go for CD stamping.
The photograph to be pasted on CD has to be a joint one or two separate pics
of both of us?

I went for CD submission today. Despite of having spouse name added in the CD I was charged 6% stamp duty. I was told this is due to the fact that Joint name still had 'NA' in it.
 
Don't know if this will be a problem in the future.

Rajan - Was the name added manually with no sign/stamp on the CD?
Same was done in my case today even after I submitted all the docs.

I have been alloted mig flat in vk and had gone to get my husband's
name added as I got married afterwards.

I was wondering that if it does not make my husband the joint owner
and hence not eligible for any IT rebates,
I think I only lose by getting his name added and therefore paying
extra 1 % stamp duty.

How did you get a new CD issued?

Without any signature / stamp the stamping ppl wont entertain your request.
Some ppl in the group including me had this issue. In my case I got new one
issued with Dy Director help and in others case they got it stamped on
escalating concerns of stamping ppl.

Pls go on public meeting days otherwise they won't listen to you. It is
amazing how these ppl do the same process over and over again when they are
aware of such issues.

Unless his name is in joint name column in CD he will not be eligible for rebates, though stamping officer might still consider it as joint allotment and charge 5 %. Also it is mandatory to add spouse name in spouse column of CD in case you are married, otherwise you will have to submit an affidavit stating that you are single.

Not putting stamp/sign may work in your favor in terms of stamping fees as stamping officer might not consider the change as there is no stamp/sign, but you never know since they stand to gain in this case ( charge 5 % in case of 4 % ) , they might consider it :)......there are no fixed procedures and it all depends on whims and fancies of officers..

I hope you have made sure that the person who corrected your CD has updated DDA's copy as well which is kept in the file with DDA ..

Thanks Rohit - It does clarify a lot of my doubts.
I was hoping to get a new CD issued as one DDA offcial herself told me
that adding spouse name would not serve me any purpose.
So I am thinking that she might agree to issue me a new CD.

However, as you mentioned, I might be asked to submit an affidavit
that I am single.
This is the first time I am hearing about this kind of requirement.
Can you pls tell me at what stage would this be required?

Ramneet- This would probably be required if you do not get spouse name added in CD. I read this in one of the threads that this affidavit is required to be submitted by unmarried allottees as a part of possession set.... You may refer to following thread, where Anupam has posted something related to this....

Hi Rohit/Ramneet,

My wife got the allotment and we got married after the allotment (Ramneet as in your case).  We are taking joint loan and want tax rebate for both of us

And we are planning to visit DDA tommorow but still not sure wat and how

There are two spaces in CD - Spouse name and Joint's name.  so as far as i understand my name should be added in both places for tax benefits and as well as for  changing the marriage status still not sure about the steps and document needed

Can any of you help me out in this situation

Anshuman - For documents required to get your name added in spouse name column, refer to the mails in this thread and you will get list of documents.. for Joint name, I doubt they will add now, but you may still try your luck....
