The Superintendent Assessor and Collector from S Ward MCGM has provided me Property Tax amount on Carpet Area of  my flats which I need to pay in Oct.2015  Six monthly payment basis against my 2 flats. This was done under RTI informations and provisions laid by BMC acts.

Who need to all that and resolve by sitting with members having knowledge of Society regulations including Nitin Rane.

The no. of deficiencies are observed by Mr. Nitin's trailing mail it is high time to resolve.
  • What are the consequences from Co-Op. deptt. if nothing followed as per the Acts and rules   Is not known.The worry is that let we 622 flat owners not to suffer.

Please refer Bye Law No.133 :

The Secretary of the society shall give 3 clear day’s notice of meetings of the Committee to all the members of the Committee which shall state the date, time and place of the meeting and the business to be transacted there at, in consultation with the chairman of the society.
Where the Secretary of the society fails to issue such a notice and agenda of any meeting of the Committee, the Chairman of the society shall issue it.
If the Chairman and the Secretary of the society fail to issue a notice and agenda of any meeting of the Committee, the concerned Housing Federation, of which society is affiliated, on its receipt of such information and request may call such a meeting.
 
Is Mumbai District Housing Federation calling Managing Committee meetings ?

If answer is NO, all managing committee meetings after 21.04.2015 are illegal.

Managing committee has no rights -
a) To increase salary of staff,
b) To approve and pay any new contracts, or to hike contract value.

Office bearers can pay regular bills viz. Electricity, Water Bills, Property Tax, Income Tax, Security, House Keeping (at old rates) & so on regular bills, till new office bearers take over charge.



I suggest -

finalise the accounts for 2014-15, get it audited, if not done already.

Existing Managing Committee's term is expiring on 17.07.2015.

Accept that Secretary & Chairman will remain till new committee is formed.

Call AGM before 17.07.2015. (For AGM on Sunday 12.07.2015, notice has to be put up on or before 27.07.2015).

Submit all reports (Balance Sheet, Income & Expenditure etc.) to Registrar's office.

Upload all reports on Sahakar Ayukt's website.


Resignations of Secretary & Chairman are submitted to Registrar on 23.04.2015.

Election should be declared by Registrar atleast a month before it is due (i.e. by 26.06.2015).

Office bearers / Managing committee has to follow with registrar's office & registrar to get the election conducted at the earliest.

Ex Chairman / Ex Secretary / Member of Managing Committee / A member of the society can ask for the status of election under RTI Act.

Complete all documentation ('I' Register, 'J' Register & other Registers alongwith Minutes Books - AGM/SGM & MC).

Hand over the charge to the new committee at the earliest.

On to the point. Today even we do take a second opinion/advice in any crucial cases, even in the life saving doctors for a open heart surgery we take second option.
We have asked for a descriptive note on the specs when OTIS said first 90k than in meeting 50k and resends quote later 65k after the meeting. Well, no issues OTIS or alternate until lift is in tact.
You too agree that telephone and cctv cables is not the cause of lift cable breakage. It means it is not upto your mark.
Hope my doubt is meaningful.
Currently advise me what should i do. Monthly i am paying to a society without fail where there is no chairman and no secretary. MC People drive away the manager and  staff, Whom do you think am i suppose to search.
Let it be dhoot ka dhoot aur paani ka paani.
