All,

Below is a follow-up from Adam Dash, attorney for Posto, who wishes the DSTF
list to be notified of Planning Board and Zoning Board Hearings on 10/22 and

Subject: 187 Elm Street-Posto

Lee,

Although I do not think that 187 Elm Street requires any zoning relief for
Posto to operate there, in the interest of being inclusive and clearing up
any misconceptions, my client has agreed to apply for a special permit to
open his restaurant. The special permit will be to change the use from fast
food with outdoor seating to a restaurant with outdoor seating. Certainly,
a restaurant is a less intensive use than a fast food place. If the fast
food use remained, a Wendy's or Burger King could open there by right, so
this special permit is better for the neighborhood.

The Planning Board hearing is October 22 and the Zoning Board hearing is
Nov. 4. Both hearings are at City Hall at 6pm.

I informed Alderman Gewirtz, but I also wanted you to know. I am sending
this to you because I do not know who else at the Task Force to send it to.

Please feel free to contact me if you have any questions.

Thanks.
