The recent Supreme Court judgment regarding the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, or the anti-atrocity act, has been viewed by many concerned people as a step that undercuts the law’s effectiveness in providing instant protection to victims of caste-based atrocities. The judgment, apart from diluting the provision that disallowed anticipatory bail, now requires a preliminary inquiry before a first information report is registered. Such a precondition would dent the confidence of Dalits and Adivasis who try to approach the justice delivery system. must read-

हाल ही में सर्वोच्च न्यायालय ने अनुसूचित जाति और अनुसूचित जनजातियों के खिलाफ जाति के आधार पर होने वाले अत्याचारों को रोकने वाले 1989 के कानून के मामले में जो निर्णय दिया, उसकी व्याख्या कई लोगों ने कानून को बेअसर बनाने की कोशिश के तौर पर की. इस अदालती निर्णय के बाद अग्रिम जमानत पर रोक लगाने वाला प्रावधान कमजोर हुआ है और एफआईआर दर्ज करने से पहले प्राथमिक जांच अनिवार्य हो गई है. इससे न्याय की गुहार लगाने की दलितों और आदिवासियों के उत्साह पर नकारात्मक असर पड़ेगा-
