A personal, but not that personal, issue is conveyed here.
The Hon. High Court of Kerala has set aside the revenue recovery proceedings against me and has directed the Dy Director of Panchayath, Ernakulam, who is SUO MOTO IMPLEADED as additional Respondent No 6, is directed to hear my objections to the recovery proceedings and pass appropriate orders after hearing the Chottanikkara Panchayath as well. It says that further action can be taken only on the basis of decision taken by the said authority and that the proceedings shall be concluded within a period of three months.
This is a case of harassment by congress led panchayath of Chottanikkara and unscrupulous elements in the state establishment meted out to me for having worked as co-ordinator of Panchayat Vikasana Samithi under Peoples Plan Campaign during 1997-2001.
UDF was aggrieved as they could not make money out of the projects. Officials were aggrieved as they could not collect bribe from contractors. So, they raised false allegations in the Local Fund Audit report.
In order to settle these audit objections, VACB enquiry had to be faced twice in the past. VACB cleared the charges. What is left was return of unspent advance to the tune of Rs.2,44,673/- that is actually due to the Panchayath from the Vikasana Samithy. At the same time bills amounting to around Rs 4,00,000/- were due to be received from the Panchayath by Vikasana Samithy.
The issue is one of settling the accounts between the Panchayath and the Vikasana Samithi constituted and owned by the panchayath itself. But I was harassed for it all through the past twenty years.
Now the Hon. HC presided over by Hon. Justice A Muhamed Mustaque has given a clearly speaking orders in my favour.
Adv Prasanth Sugathan, the well known Free Software activist and legal advisor to Software Freedom Law Centre (SFLC) has prepared the case, appeared inthe court and won the case for me. He has done a very great favour to me and my family. He saved me from the ordeals, I had gone through the past two decades.
Words are not sufficient to express my gratitude to him, especially so, when many other advocates whom I as state secretary of T.III (NFPTE) was given dozens of cases were reluctant to take up this case.
Thanks, Joby John for suggesting Prasanth, while I didnot think of him, though I was so close to him in Free Software Movement, as an advocate while I am attached to and familiar with many others advocates.
Thanks, Prasanth Sugathan and Varsha Bhasker for the favour shown to me.
