Hello everyone!

Happy new year and welcome to our next at-large project in the CyberOne series.  Harvard Law School has a short, intensive semester for the law students during the first three weeks of January.  This semester Professor Nesson is offering a course in Evidence and Trial Advocacy.  The theoretical aspect of the course addresses the question of how the American legal system provides (and sometimes fails to provide) dispute resolution by manufacturing acceptable truths.  On a practical level, students in the course will be learning about actual courtroom practice and how to understand and use the rules of evidence that structure courtroom procedures. 

At-Large Participation

As with CyberOne, the course is open to at-large participants and we invite and encourage your participation.  We will be structuring the at-large component of the class differently than we did in CyberOne.  In the first two weeks of the class we will be posting videos of the lectures both on the course website and on the bank of screens on the north side of Berkman Island.  Next Monday evening (1/8) and the following Monday evening (1/15) I will be leading discussion about the topics from the lectures from 8-10pm EST (5-7pm SLT) in the main amphitheater on Berkman Island.  In the last week of the class (1/16-1/19) we will be doing something VERY EXCITING!!!!  We have built an open air courtroom on the north side of Berkman Island that we will be using to hold a trial.  We will be trying the case of Bragg v. Linden Labs.  Professor Nesson will be the judge.  Teams of students enrolled in the Harvard Law School class will serve as the lawyers for the plaintiff and the defendant.  And we invite you to participate by acting as the jury for the case.  In addition, we will likely be seeking a few volunteers who can role play witnesses in the case.  We may also be seeking someone to serve as an expert witness about the land purchase system in Second Life.  .  I will be leading discussion of the proceedings in the public gallery at the back of the courtroom where anyone who wants to simply watch and talk about the trial is invited to come sit.  This trial is the first of its kind in Second Life and offers a great opportunity to interact with Professor Nesson and the law students.

Bragg v. Linden Labs

The case we will be trying concerns former SL resident Bragg who joined SL and bought some property through the regular property auction system.  He then discovered an exploit that allowed him to buy a bunch of additional property in SL at well below the market value.  When Linden Labs became aware of this they terminated his account and seized all of his property without compensation, including the property that he bought prior to discovering the exploit.  He is suing Linden Labs in federal court for the value of the property that he acquired without use of the exploit.
