When contacted, Public Information Officer for Crime Branch and ACP
(Crime) Sanjay Jadhav said, "My office has not received any such RTI
application till now."
Section 7 (1) of RTI 2005 makes it mandatory for the public
information officers to provide information sought under RTI as
expeditiously as possible within thirty days or reject the request for
any of the reasons specified in sections 8 and 9 of the Act.
Section 7 (2) states if the Central Public Information Officer or
State Public Information Officer, as the case may be, fails to give a
decision on the request for information within the period specified
under sub-section (1), the Central Public Information Officer or State
Public Information Officer, as the case may be, shall be deemed to
have refused the request.
The RTI application demanded information on the cyber lab and cyber
cell of the city police with queries ranging from the first proposal
for setting up the lab, budgetary allocation, clearing authorities for
getting permission and approval of the sanctioning authority, date of
commencement, total number of computers, modems, furniture and
available staff including the sanctioned strength from DCP rank to
PSI.
It also sought answers to questions like did the government
specifically sanction the post of DCP exclusively for cyber crime and
cyber lab and under what government resolution (GR ), total number of
cyber crimes registered since the establishment of the lab comprising
details of the complainants, names of the accused, whether the cyber
crime cell co-ordinates with private computer and IT companies and
seeks their help in investigations and copy of agreement of co-
operation between the police and the private professionals if any and
was prior government permission taken before getting the approval for
the agreement.
