to Cyber Law - India
Off late, crimes using cellphones and multimedia technology have
increased but our laws have been left totally outdated.

For instance, the DPS MMS case involving two students of the school,
which shocked the country; yet ore than two years since the case first
came to light, nobody has been punished.

Thus, now the government has prepared a draft of amendments to the
Indian Penal Code, which proposes two years imprisonment for anyone
sending obscene content.

In fact, a new chapter has been added to the IPC to define what
constitutes violation of privacy.

The chapter pertains to those who intentionally film private parts of
a person without their permission and then transmit them through
multimedia for others to see.

Such MMS senders face not just two years in prison but also a fine of
Rs 2 lakh."What's very encouraging is that the new law makes it
technology neutral; so while the earlier IT Act was ambiguous whether
it applied to cellphones, now it is very clear," said Subimal
Bhattacharji, Cyber expert.
