GE13 Incidents Analysis – Interim Report.


There are 3 checklists of evidence that election petition lawyers look for: (courtesy of Edmund Bon)

Types

1. General Corruption,

2. Specific Corruption,

3. Breach of election procedures/law/regulations.

 

From the reports received by us, we identified 64 types of Incidents, totaling 439 incidents.

These incidents could be classified under 16 Groups

Almost all the Groups fell under EP Type 3 – Breach of election procedures/laws/regulations. This is not surprising as the reports were from the PACABAs (Polling Agents, Counting Agents and Barung Agents.) The legal substantiation or implications with each group are being prepared.

 

In terms of frequency, the most common violations were in:

Group 3. Breach of Official Duty, including collusion (23%),

Group 2. Secrecy & Undue Influence (13.4%)

Group 11. Systemic Fraud (12.8%),

Group 8. Creation of administrative obstacles for calons. 10.9%)


In other words, almost 60% of the problems came from the EC Officers.


In the final report, we will try to look into the causes of this problem and the solution.

 

We have identified for each Group, the Parliament constituencies affected.

And also, for each Parliament constituency, the Groups involved.

Of the 29 Parliamentary seats (8 GE13 EP Cases.pdf) that Pakatan Rakyat wishes to lodge an election appeal, we have found that 5 seats are covered in our reports.

P096 Kuala Selangor

P116 Setiawangsa,

P140 Segamat.

 

4 teams are working on this and we should have their reports by next week. After this is completed, we will proceed with an analysis of the other reports.


The last date for the filing of election petitions is 17th Jun 2013.

The way to track the various reports is to identify the Report no. This Report No. can be used to locate the reports in various files.

 

Meeting:

The meeting scheduled for Sunday afternoon, 2nd Jun is cancelled.

Group O: Yong TE & team.


All GE13 Incident Analysts and those who reported to us on the incidents are invited to attend. We will discuss the general findings.

This is to record our appreciation to our members who worked so hard to reach this stage:

Tuan Hock Liew, Dr. from JB: Who came up with the idea for this initiative and led the team
Singam: Advisor
Deanna: Who did all the hard work organizing and allocating the duties to the various analysts. This was real hard work.
Analysts: Too many to name, many who came forward to cover others who were not able to analyse their quota. Some took on 3 batches.
Counselors: Those who gave the analysis for the groups. This is ongoing as we still have a lot outstanding.
