Kennedy on Monday, May 16, 2022, to announce an effort in support of state mental health parity laws recently impacted by a decision in Wit v. United Behavioral Health, a case before the Ninth Circuit Court of Appeals.

WHAT: In 2019, a federal district court judge ruled the nation’s largest managed behavioral health care company (United Behavioral Health) wrongfully denied mental health and addiction treatment coverage to tens of thousands of subscribers. In March 2022, that ruling was overturned, setting a dangerous precedent for how treatment can be covered nationwide—even as the Surgeon General, the President, and other national leaders warn of a serious mental health and addiction crisis in the wake of the pandemic. United violated Rhode Island, Connecticut, and Illinois state law in denying addiction care to state residents, however, the 3-judge appellate panel ignored these findings by the federal district court when it reversed the trial court ruling.
