Dear All,

What documents will be required to be attached in Form DIR-3 KYC for person holding Certificate of Registration of Overseas Citizen of India (OCI).

And, can a practicing CA/CS attest the documents.

Pls suggest.

Thanks.

Attach PAN card, Aadhaar Card, Passport, OCI Card.

Yes, a practicing CA/CS attest the documents.

In this case, he'll have foreign passport. Thus, notarization & apostilization of the same would be required.
Further, if his present address is different from the one in his passport or if there is no address in his passport, address proof would be required. If address proof is for foreign address, it'll be required to be notarized and apostilled as well.

A director is having Australian passport. Nationality on passport is Australian.

Where to get notarize & apostatize the same ?

Someone suggest that apostilization can be done at Australian embassy located in India. Is it correct ?

Its urgent kindly answer.

Documents were already notarized in Australia but DIR-6 was rejected due to the reason that Attestation is not as per MCA guidelines.

Incase the Australian citizen/national (holding OCI Card) currently does not have any foreign address & if he stays in India, then no need of getting his documents apostilled. Professional's attestation would suffice. I did for my client who was a UK citizen but resident in India wherein his documents were not apostilled. Its only incase if he stays abroad, then he has to go through such procedures.

I agree with Kartik's view, because that person is a resident in India having other than Indian Nationality.

And if a person is resident in India then why apostilization is required?

In my view, need for notarization / apostilization is based on the type of document and not on residential status. If document is issued by Indian authorities its not needed, however, if passport, DL, utility bill is issued by foreign country's authorities it'll be needed.

Dear Mr. Karthik,

i had filed DIR 3 KYC and DIR 6 for a person holding OCI card and USA passport.
DIR 6 has come up for re-submission with a remark "Please give Permanent address as per Nationality mentioned in DIR 6"
I had mentioned his Indian address , both in DIR 3 KYC as well as in DIR 6
The Individuals USA passport does not mention his address in USA, nor does he have any address in USA.
His OCI card has an address of his in USA, but the OCI card is for an infinite period and has not mention that is is for infinite period nor date of validity / expiry.

now how do i go about re-submitting the DIR 6 , further there will be a mismatch between DIR 3 KYC which is approved already and the DIR 6 .

pl share your views on this situation.

regards,
Mohan
