Form AOC - 3

Dear All,

Please help on this query:

Form AOC - 3 is introduced by MCA as annexure to financial statements in accordance with Sec 136(1). Now, my doubts are whether this form is required to annexed with annual report of Company before AGM including Private Limited Companies.

IN MY OPINION, YES U SHALL ATTACH FORM -AOC3 BECAUSE IT IS A DOCUMENT REQUIRED BY LAW TO BE ANNEXED OR ATTACHED TO THE FINANCIAL STATEMENTS WHICH ARE TO BE LAID BEFORE A COMPANY IN ITS AGM AS PER SEC - 136(1) .

AS NOTHING HAS BEEN SPECIFICALLY MENTIONED ABOUT PRIVATE COMPANIES BUT IT IS RELATED TO THE RIGHT OF THE MEMBER OF COMPANIES SO , IT SHALL BE ANNEXED WITH ANNUAL REPORT ALONG WITH OTHER DOCUMENTS BEFORE A.G.M.
