form DIR-12 - rectification.

Dear Members,


I have filed form DIR-12 for appointment of Director, by mistake I have mentioned as Director instead of additional Director. Form has been uploaded with director, even in MCA  also showing as director.

Its Private Limited Company with 1 lakh Capital.

How to rectify this and how to make as additional director. Please suggest.

File Application with Affadavit to mark form as Defective to the Respective ROC. Then after you can file Revised Form with additional Fees.

it is small Company. some professionals are saying  it is ok.

Companies Act Does'nt give exemption to small companies to appoint a person as director in the Board meeting. You have to decide whether you want to go with companies Act or Professionals.

If you file DIR-12 again then in mca database will show same person appointed as Director and as additional director.
