Hi,

Auditor is appointed at the AGM held on 30.09.2014 for a term of 5 years. What do we need to mention in new form ADT-1 in Clause nO.4(f) wherein it asks for the period of account for which auditor is appointed. Should it be 01.04.2014 to 31.03.2019???

Kindly let me know regarding it.

hello Neha whether it mean that we r required to file ADT-1 only once if appointed for 5 years and remains the same for 5 years i.e no resignation.. or we r required to file ADT-1 for every year AGM for the ratification done by members in each AGm during these 5 years ?

nothing is clearly specified in the Act if ADT-1 needs to be filed only once in 5 yrs or every year after ratification by members

yeah nothing is written any where.. but the Auditor certificate and consent which is to be given by the auditor certifies his eligibility for that particular year only and not for all the 5 years.. so how it will be intimated to Roc.. whether it will be done internally..?

i have taken Auditor consent with the language for the period as may be approved by the members in the ensuing AGM of the Company.. though both mean one and the same thing.. but i think we have to file this form for every year AGm.. other expert views pls.

ADT-1 will be filed once only ratification is matter of record.

So what is final opinion... what should we enter in Period of Accounts will it be 01/04/2014 to 31/03/2015  or    01/04/2014 to 31/03/2019

Plz... its very urgent... 

and Is consent letter only the document attached from Auditor

Do we have to appoint auditors for 5 years to those companies on which rotation will not be applicable?

Rules has provided in detail the appointment period..it may be 9yrs/..../ 5yrs / 4yrs/ 3yrs..etc...if the firm/individual is working as auditor since before commencement of the Act.
