Dear Friends,

Good Afternoon.

A director is disqualified by ROC under Section 164(2) of the Companies Act, 2013. He has not yet filed Form DIR 3 KYC.
Now he wants to file Form STK-2 (Strike Off) for another company. Please let me know whether he will be able to file Form
STK-2 after updating his KYC.

An early reply in this regard will be highly appreciated.

Thank you in advance.

No. It is not possible.

Due to disqualification of his DIN.

You can file WP before the High court and get stay. Once it is activated, made by the ROC, you can file closure application.

with regards

Why not.
He can file for the company in which he is not disqualified.
But his DSC cannot be used

After Disqualification attract to the Director
All act done by that Director can't be valid.
Whether that act done in defaulting company or any other where he is hold Director ship.
