Surrender of DIN

Dear All

Can Directors surrender the DIN as they are nowhere holding directorship currently but they were directors earlier in one company which was strike off in 2016.

So, can they surrender the DIN?

I had tried to surrender DIN of director of a  company  whose name  we had struck off  u/s 560. But system displayed message that  director  should not have filed any  form  using that DIN. hence  it could not be surrendered. 

I do not present status  Whether MCA  has made  any changes in above rule

The said Company of our's was also struck off u/s 560....but now when DIR-3 KYC comes into picture so from now will have to file DIR-3 KYC for that Directors every year if their DIN will not be surrender in such a case..as then no option left..

And why this error comes that "should not have filed any form using that DIN", if it is so then what option left apart of updating KYC every year.

Me aslo finding for the same answer.

As per some experts -
If a person held directorship in any company during his life using such DIN, that DIN can’t be surrender by filing of e-form DIR-5.

If DIn are associated or used they cannot be surrendered today itself MCA has given clarity you can check MCA website MCA Update: As per the extant rules, in respect of an individual who is in possession of Duplicate/Multiple DINs, he can retain the Oldest DIN only. DINs obtained later have to be surrendered. Further DIN once associated is NOT eligible

for surrender. Stakeholders may kindly take note and plan accordingly.

Excellent suggestions by ICSI. In fact I think the reference to TM while applying for name should be done away with altogether. If at all any company has any dispute qua TM then let them fight it out at TM registry.

In fact  ICSI  also has  woke up very late. It appears  they realised this only when  DIR3  KYC  was  introduced. any way better late than  never
