Urgent Query - Whether Resident Director or Indian Director.?

Dear All, 

We are in the process of incorporation & filed the name application with two directors of which both are Foreign nationals but one among them is residing in India for more than 182 days. 

The ROC has raised the query that there should be an Indian director in the company. 

Whether there should be an Indian Director or Resident Director.?

Dear All, 

Finally I got the clarity w.r.t the subject that as per Section 149(3) read with Circular 25/2013 dtd 26.6.2014, a Company is required to have the "RESIDENT DIRECTOR"  from the date of its incorporation but not the Indian Director. Accordingly the Office of ROC Bangalore has approved our application for name. 

Resident Director for this purpose means a person who stayed in India for more than 182 days during the Previous Year.
