check list for closure of companies under section 560

I am forwarding press note 1 (2009) as well as check list of closure of companies under section 560 of companies act, prepared by our fellow member.

Section 560 of the Companies Act 1956, provides for ROC's action where he has reasonable cause to believe that a company is not carrying on any business or operation.

 

However, the section does not provide for voluntary application by companies for getting their names struck off from the ROC register.

 

Please clarify me, whether a company can approach ROC voluntarily under this section?

 

In your experience, have any ROC taken such action on the basis of such voluntary application?

 

The simplified exit scheme is no longer available to the companies. So, how can the above be carried out?

Hi Madhwesh,   ROC has clear instructions from the Ministry to get rid off defunct companies from the register of the companies ( In order to downsize data in MCA servers). As per instructions, the Bangalore ROC did strike-off not less than 1500 companies in suo moto action and 500 companies on application (in similar format to SES2005) voluntarily filed by the Directors interested.   Hence ROC, Bangalore does welcome the voluntar application under section 560.
