Dear Members,

Request your opinion :

DIR -6 (Change in Director Particulars)  - Should Supporting Documents be attested with seal by certifying professional ?

Reason for Query : Filing has got returned with status as cited above.

Rule 12 is reproduced which does not state so, nor does DIR-6 form (barring photo attestation) :

Rule 12 Intimation of Changes in Particulars Specified in DIN Application

(1) Every individual who has been allotted a Director Identification Number under these rules shall, in the event of any change in his particulars as stated in Form DIR-3, intimate such change(s) to the Central Government within a period of thirty days of such change(s) in Form DIR-6 in the following manner, namely;-

1[(i) The applicant shall download Form DIR-6 from the portal, fill in the relevant changes, verify the Form and attach duly scanned copy of the proof of the changed particulars and submit electronically;]

(ii) the form shall be digitally signed by a chartered accountant in practice or a company secretary in practice or a cost accountant in practice;

(iii) the applicant shall submit the Form DIR-6;

Yes all the attaching Docs must be certified by CA/CS/CMA.

for you assistance please see below






The eForm should be certified by a chartered accountant (in whole-time practice) or cost accountant (in whole-time practice) or company secretary (in whole-time practice) by digitally signing the eForm.
Select the relevant category of the professional and whether he/ she is anassociate or fellow.

Enter valid membership number and certificate of practice number of the practicing professionals.

The supporting documents attached with the e-form shall be attested by the Chartered Accountant or the Company Secretary or the Cost Accountant, in whole-time practice.

Hello Mr. Sachin,

Thanks. The rules nowhere states so. Neither does the DIR-6 form explicitly brings this out except for photo. It is only in the DIR-6 help manual the attestation related statement is mentioned, which does not makes it binding as a rule.

My Query :
a. Does statement in  the help manual makes it a rule or override the rule?
b. When the Dir-6 form explicitly state for photo to be attested and is silent on supporting documents,,

Does the ROC is within permitted laws to reject the submission ?

U need to get certified by PCS... even we too got dox resubmission.

Thanks.  The practising certifying professional is certifying the DIR6 form, why the attestation apart from certification ?

On top of attestation and complying with the stated remark, on resubmission, it is returned for notarisation. I am left to wonder what the actual rules are, coz, why attest when they want it to be notarised ?

Anyway, no choice have to ensure succesfull 'n' resubmission.

Dear Bala Ji,

It's not just about DIR-6, even whiling filing DIR-3, all supporting documents have to be attested by the Professional.

However, DIR-3 is STP Form so it gets automatically approved and DIR-6 not being STP, we are left with no other option than to certify the supporting documents.

Please let me know, what all are the supporting documents in cas of change in name spelling of the director. Do i have to attach DIR 7 affidavit also? If yes please send me the draft, it would be very grateful.
