Filing of form ECB-2

Dear All,

 

Kindly clarify on this matter,

 

Our Company is going to come up with the ECB, we have taken Loan Registration Number (LRN) issued by RBI, but still we did not take any money from the foreign party, and as per RBI circular on ECB, every Company need to file a report on monthly basis by submit form ECB-2.

 

My query is whether in my case also do we need to file ECB-2 with NIL amount, as we did not take any amount of money from foreign party yet or we would required to file it for the first time for the month when we will receive the money.

 

Kindly do the needful, will be very thankful to you.

Dear Neha

 

You need to file the monthly returns in ECB-2 format as and when the LRN No. is issued, even though u havent received any proceeds under ECB, so you can file the NIL Return.

Please clarify one more point, in our case we got the LRN in the month of march, so in that case i need to file form ECB-2 for the month of April till 7th of May as it should be filed within 7 days of the month for whhch it relates, m i right?

 

Further, if you have word format of ECB - 2, then kindly mail it to me. will be very thankful to you.

Our Company did not file Form ECB - 2 for a month of March which needs to be filed till 7th April, 2011, and now company wants to file it for the month of April, then what would be the penalty in that case for non filing for the month of march, can we file it for both the months simutaneously?

You can write a letter to your Authorised Dealer stating the reason for non-submission of ECB-2 for the month of March saying that it was due to inadvertance..and further ECB returns will be filed in time from now on....
