Charge beyond 300 days

We need to file condonation of delay of CHG 1 for charge creation do we need to submit file and appear before RD too??

Usually  they do not insist. File  Form CHG 8 with all documents properly.Based on the no of delay they fix the penalty/ additional fees and send the order

Have you filed Form CHG  4. File  then Form  CHG 8

Yes, you  get notification for approval of form

Hard copy of the order will be sent by post. You need to file it with jurisdictional ROC in Form INC 28.

ROC will act on it and removes the  charge from the register.

Actually it's CHG 1 we have yet not filed the form.

That's why asking if only online will work ?

Sorry, some how I was carriedvaway by chg 4 regbsatisfsction. CHG is to be filed withinn 120 days else you can not file any form or there is any condonation.

As law stands todau, it is not possible. ROC may issue notice and may levy fine. It seems amendment act may bring some new provisions

Now you can file with Ad Valorem Fees no need for condonation it gets filed with additional fees as per borrowing amount

Ad valorem is only for additional time of 60 days. So total time is 120 days.

In my opinion, you can not unless ROC initiates action against company and allows as part of compounding process or on payment of fine.
