Hello,

Kindly provide inputs to the following query.

Do the selection of option "Executive" in incorporation form, makes directors WTD within the meaning of Section 196 and will their max. tenure be only 5 years.

Executive director itself indicates that he's a whole time director. Hence he can't work on part time basis which will involve violation.

Yes it will make them as essentially a WTD. If you are a private company you will not be affected as no reporting to be done, but in case of public company tenure should be fixed and MR-1 to be filed ideally. However I have seen many cos not doing this. I assume it is because option of "Executive Director " is not available in MR-1. Can any members confirm?
