How to correct details in MGT 7?

Dear Members

We wrong wrote  "Financial year end date to which AGM relates as 30/09/2014 instead  of 31/03/2014.

due to this we are unable to file some other forms like AOC  . Can anyone guide as to how to make this correction in MGT 7

File Rectified MGT-7 again without doing any application to ROC.

You need to file MGT7 again with correct details by paying fees again .

 As Form is Stp Form, Its does not matter that Mention reason to file it again. 

Go ahead File revised MGT-7 with paying additional fees.

Please attach a clarification letter stating the previous srn and date of filing and then the reason why you are filing a revised form.

Whether the form is stp or non-stp, it is always better to poiint out the mistake in the previous form.

How did   system accept the form if date was mentioned   as  30.09.2014  as it means  the financial year was more than  12 months.

You have two options:

1. File  revised MGT  7 with new correct

2. File AOC 4 also with  date as 30.09.2014    and   attach a note that  you were forced to  mention date as 30.09.2014 because of inadvertent  error made in   filing MGT 7.

(this you  can use  as defence   in case  of scrutiny or inspection )

3. In case you really want to follow  ,legal procedure  , please follow Rule 10 of Companies (Registration  offices and Fees ) Rules 2014. 

Here make a letter to ROC,  mentioning the  error ( with copies of MGT 7 ) and request for permission  to  file revised MGT 7

ROC will verify and  will allow  filing of new MGT&

File   revised MGT 7 with additional  fees

ROC will ensure that old MGT is removed from the  MCA portal

You will have to visit ROC and get  this done.  This is fool proof   method, though it will cost you additional  fees.

There is possbiility  that ROC may ask you to get the offence ( mentionng wrong particulars) Hence it may be  expensive.

So talk to ROC before  making  letter  and take his views.

This procedure is applicable for all forms
