Error in Form INC-22A (ACTIVE)

Dear Members,

Please reply on following query:

We have filed Form GNL-2 in FY 14-15 for appointment of auditors upto 31.03.2019, since at
that time form ADT-1 was not introduced and all companies were filing appointment of 
auditors through GNL-2.

Now, when we are trying to fill Form INC-22A (ACTIVE form), in this form, when we are doing
prefill, the details of auditors is coming 0 (Zero), but actually we have filed intimation of 
appointment of auditors through Form GNL-2 at that time.

Now please advise what we can do so that details of auditors are prefill in Form INC-22A and
we can timely file Form INC-22A.


Please reply as soon as possible.

We too face this situation with a slight difference. However, we have taken up this matter to ROC, Chennai who will get back to us by 9th or 10th instant. 

We had been filing ADT-1 for ratification till FY 2018. Last year in May, the CA was amended to do away with annual consent of members and attached compliance of filing ADT-1. So, we did not file ADT-1 for FY 2018-19. The 22-A form prefills auditor period based on ADT-1 filed for FY 2018. It does not consider the initial non-Eform ADT-1 filed with GNL-2 in 2014. When this was highlighted through a ticket, it was swiftly closed with usual template answer by MCA: "Download fresh form and try filling".  In the webinars, we were assured that MCA would look into GNL-2 forms filed prior to 21-10-2014. We wonder how our form got overlooked !

I have to point out that ADT 1 has to be filed only once and not every year. In 2014, all the compliant companies duly filed the ADT 1 under GNL 2 and there is absoluteely no need to file ADT 1 again for reporting ratification. I reckon thousands of companies would have filed ADT 1 under GNL 2 well in time and all of them are unable to file INC 22A for the simple reason that MCA had forgotten this aspect and designed the Form to copy the details from the E Form ADT 1. Now that it has been pointed out to them, they are reluctant to accept their mistake and playing around with the irrelevant plea that many companies still filed GNL 2 even after the introduction of the E Form ADT 1. The objective of this INC 22A is not to fix such companies. MCA can deal with such companies separately, even while enabling the manual filling up of the particulrs of the Auditors

will MCA set right this GNL 2 issue or will they cut a sorry figure in the end to earn Rs. 10,000 as the Co will be marked ACTIVE non compliant on and after 26th April 2019.

should we wait for this, or should we think of alternatives ,

members please share ur views.

They have to set this right for sure. Without doing that, there is no point in invoking all companies and Directors to file the Form and also in issuing a threat that no extension of time would be given. But for this ADT 1 muddle authored by MCA, most of the companies would have already filed the Form and get done with that.
