Query regarding filing of form APR under FEMA guidelines

Dear Members,

Can you please clarify about the time of filing of Annual Performance Report (Part-III of Form ODI in FEMA guidelines), as it says the form is to be filed within 60 days from expiry of statutory period of host country",

now the question is statutory period is of Indian company or of WOS abroad?
 
and whether 60 days is from signing of annual accounts of WOS?

Would appreciate your early response.

Dear Ms. Neha,

 

To my knowledge, it is within 60 days from the expiry of statutory period fixed in the host country of the WOS to finalise the accounts

 

Statutory period is of WOS and 60 days is not from signing the accounts, but from the  expiry of the statutory period fixed to finalise the accounts as per the laws of the country where WOS is situated.
