thanks Mr. Vijay.. can any one pls confirm whether this form needs to be on the letter head of the Company or simply we can file this form on plain paper ??

Dear Simranjeet Singh,

 

This is a form by Ministry and hence  just take print and fill in handwritten, take signature of director of company and file the same with GNL-2, along with Certificate from auditor and Consent of Auditor.

How to file this ADT-1 ?, I think this is substitute for earlier Form 23B, with only difference is that the Form 23B was required to be filed by auditor and ADT-1 by co.

i believe no format as such is given by mCa.. but a one is to be made taking care of these points as mentioned in auditor rules

4. Conditions for appointment and notice to Registrar. — (1) The auditor appointed under rule 3 shall submit a  certificate that - 

(a) the individual or the firm, as the case may be, is eligible for appointment and is not disqualified for appointment  under the Act, the     Chartered Accountants Act, 1949 and the rules or regulations made thereunder; 

(b) the proposed appointment is as per the term provided under the Act; 

(c) the proposed appointment is within the limits laid down by or under the authority of the Act; 

(d) the list of proceedings against the auditor or audit firm or any partner of the audit firm pending with respect to professional matters of conduct, as disclosed in the certificate, is true and correct. 

(2) The notice to Registrar about appointment of auditor under fourth proviso to sub-section (1) of section 139 shall be in Form ADT-1.

How will be handle it if ADT-3 has to be filed ? ADT-3 has to filed by the resigning Auditor and GNL-2 is signed by the Director. So in which e-form in ADT-3 filed ?
