No Re-submission Opportunity

Dear Members,

As you are aware there is no re-submission option available from 17.03.14. ROC is rejecting defective forms without giving any opportunity for rectification. This is even applicable to incorporation documents where significant filing fees is involved.

I have couple of queries:

1. ROC is putting following comments while rejecting the Forms. 

"Hence marked NTBR. Form is not put under resubmission in the light of Circular No. 1 & 2 of 2014". 

Can anyone is tell me where is circular No.1 & 2? I am not finding it on the website.

2. Is it correct in light of regulation 17 of Companies Regulations?

Dear Sir,

As per my knowledge, attached is the latest amendment of Companies Regulations, 1956 on the matter where ROC has to give opportunity to the stakeholders to rectify the documents. Is there any discretionary powers given to ROC barring Companies Regulations, 1956? 

Can anyone enlighten me on the legal standing/provisions of public notice/mails from ROC on this?
