REQUIREMENT OF ATTACHING DIR-4 TO FORM DIR-3

Is it still required to attach DIR-4 to Form DIR-3 as it has been included in form DIR-3 itself? If any Circulars are available please let me Know....

Hii Praveen,

Now it is not required to attach Dir-4 with DIR-3. declaration as per DIR--4 is given in the form itself. This amendment has given in the Companies (Appointment and qualification of Directors) Amendment Rules, 2014 dated 18th sep,2014

yes some people are still attaching it, but this is completely their discretion, now it is not mandatory attachment as per the form.

Gone through the Companies (Appointment and Remuneration of Directors) Amendmet Rules, 2014 dated 22.09.2014. Nowhere it is written that or I could find that DIR-4 need not be attached. Its better that we don't interpret ourselves one plain exemption. So, its my sincere advise to all my colleagues that continue attaching DIR-4.

Four New e-Forms Introduced: The Ministry of Corporate Affairs (MCA) has introduced four new e-Forms and modified two existing e-Forms in September, 2014. The new e-Forms introduced are MGT-10 (Changes in shareholding position of promoters and top ten shareholders), DPT-4 (Statement regarding deposits existing on the commencement of the Act), DIR-3C (Intimation of Director Identification Number by the company to the Registrar DIN services) and ADT-3 (Notice of Resignation by the Auditor). The modified e-Forms are DIR-3 (Application for allotment of Director Identification Number) and DIR-6 (Intimation of change in particulars of Director to be given to the Central Government). In order to further simplify the filing of e-Forms, requirement of affidavit along with e-Form DIR-3 and DIR-6 has been dispensed with. Now affidavit in e-Form DIR-4 and DIR-7 has been converted into a declaration and merged with DIR-3 and DIR-6 respectively.

Accordingly e-Form DIR-4 and DIR-7 are dropped.
