ROC RESUBMISSION FORM NO. 5

Dear Members

I have filed Form No. 5 of a Company for Increasing Authorised Capital on 31.01.2012, but now i received a communication from ROC that the form attached is not clear and they have instructed me to resubmit once again.  I would like to know whether I have to pay the fees once again for resubmission. I have paid 30 thousand for filing form No. 5 and Rs. 1 thousand for stamp duty.  Please suggest me at the earliest.

You need not pay the fees again.

 

You have to fill up a fresh fom No 5 and then upload it in the resubmission mode.

I dont think so prepare the form with suggested changes and then resubmit the form. there is an option of re submission, no need to pay the fees again.

Your submission again amounts to removing defects, deficiencies and therefore, in my opinion, you don't need to pay fees again. Just quote their letter reference and resubmit the required details

please also suggest that in case of increase in Authorised capital , we have to pay stamp duty now or not on the increase capital .
