Dear Members

I have filed form INC-1 and ROC has sent the same for re-submission saying proposed name phonetically resembles with an existing company.

However when I checked status of this existing company I noticed that it has been stroked off. It may be possible that ROC may not have checked "Strike off" status when sending my form for re-submission. Is there any possibility to get proposed name approved in light of this finding or still ROC will disallow my proposed name?

Regards,
CS Mahesh Joshi

Dear Mr. Joshi,

Kindly refer to name availability guidelines:

Provided that if the proposed name is identical with the name of a company which is struck off in pursuance of action under section 248 of the Act, then the same shall not be allowed before the expiry of twenty years from the publication in the Official Gazette being so struck off;

Warm Regards
