Dear Sir Kamalakar,
As per section 165 Statutory meeting is to be conducted not within one month or not more than six months from the date of commencing business. Here "date of commencing business" means date of COB Certificate. So public co must conduct Statutory Meeting only after taking COB Certificate.
With relates to your reply:
My question to you is "If the company is unable to apply for COB, is it means to violation of section 165???".
Because you mentioned that "within the time stipulated for Statutory Meeting u/s 165, the company is required to take CCOB. Otherwise very purpose of holding Statutory Meeting will fail."
Warm Regards,
Sheikhar Naik
