Urgent : Commencement of Business Certificate and Statutory Meeting

1. What is the time limit for apply commencement of business certificate and to conduct statutory meeting?

Every company limited by shares, and every company limited by guarantee and having a share capital, shall, within a period of not less than one month nor more than six months from the date at which the company is entitled to commence business.

here is a time period of six months of incorporation within which you have to obtain commencement certificate. If you don't do that, the ROC has the powers to strike off the name of your company.

Hi,

Statutory meeting is to be conducted within one month to six months from the date of commencing business and I don't think there is any time limit for applying Certificate of commencement of business but companies usually does (applies for Certificate of commencement of business) it after incorporation. Pls correct me if I am wrong.

Dear sir if no. one co. applying for the commencement Certificate or start business activity more than 1year ROC having the power to order for winding up sme.

I think within the time stipulated for Statutory Meeting u/s 165, the company is required to take  CCOB. Otherwise very purpose of holding Statutory Meeting will fail.

Dear Sir Kamalakar,

As per section 165 Statutory meeting is to be conducted not within one month or not more than six months from the date of commencing business. Here "date of commencing business" means date of COB Certificate.  So public co must conduct Statutory Meeting only after taking COB Certificate. 

With relates to your reply:
My question to you is "If the company is unable to apply for COB, is it means to violation of section 165???".
