Form ADT 1 has been filed twice by 2 different Auditors for the same Company

Dear Experts,

Form ADT 1 has been filed twice by 2 different Auditors for the same Company with the ROC.

Can any member help us how to rectify the same ?

Interesting .....

what is the date sequence for these 2 e-forms ?

is there a considerable gap in filing these 2 forms by the 2 auditors ?

if there is not much of a time gap then it must have been done inadvertently ? which is no excuse - lack of co-ordination by the Co and managing their affair without adequate diligence !

May be the 1st Auditor (whose form was filed first) needs to file for his resignation as well.

Best is to check with ROC concerned to overcome the problem. Hope it is not a case of Joint auditors !

Dear CS Mohan Ji,

It has been filed showing appointment in 30.09.2014 by both the Auditor.

How can we resign & both the Form has been separately showing as Individual Auditor hence joint auditor is also not possible.

Please guide if any other course of action availabel.

Dear Alpesh,

the MCA mechanism should be such that it should not have taken the other Form ADT-3 as such in first place or without raising a message/query.

The concerned auditor should provide the Form ADT-3 filed with reason-Form filed due to inadvertence.

Dear Alpesh Ji,

 In notice of AGM, which auditor is showing appointed as auditor for next year, that auditor form will be correct and for other you have to file resignation in ADT-3 for wrongly filed ADT-1.
