Auditors appointment - ADT-1

Dear Members

 We have filed ADT-1 in 2014-15 for appointment of auditors for 5 years.

In this AGM, we have ratified the appointnment of Auditors, do we need to file ADT-1 again for fy 2015-16

Please suggest

So that resolution not to be filed in any form with ROC  right ?

This being only a Ratification rather than an Appointment or Re-appointment of Statutory Auditors at Annual General Meeting, ADT-1 is dispensed with.

Thanks everyone. Even I am of the view that ADT 1 need not be filed this year. Even the consent and eligibility certificate need not be obtained from auditor this year.

However we understand the RoCs at Bangalore and Delhi are of the view that ADT 1 has to be filed for every year of ratification.

Even in AOC 4 we file for B/S and P&L, the SRN of ADT 1 has to be provided. Can we use last year ADT 1's SRN?  

Again during last year, we had filed ADT 1 in pdf format attaching in GNL 2 for many companies and the word format of ADT 1 did not contain details of term of appointment. Hence RoC electronic records would not have been updated the term the auditor was appt last year. Having said this, SRN of GNL 2 can not be used now and ADT 1 has to be filed at least for the companies we had filed GNL 2.

It is better if MCA officially clarify this matter.
