DIN 1 - Citizen of India but NRI

Dear Friends.
 
The Form DIN 1 shows option for Citizenship for India yes or no, if we select it yes, then it will automatically suggest states to choose. But if the person does not have any documentary evidence of India and his passport suggests the address of outside India though Citizen of India, how can we proceed further? As after selecting Yes for Citizenship of India, it will mandatorily asked PAN which if the person does not have, it will not validate the form.

hELLO,

If you select citizen of India 'yes', you have attach certified true copy of PAN and address proof. PAN is mandatory for citizen of INDIA and PASSPORT IS MANDATORY FOR FOREIGNER.

Kindly read check list of the DIN-1.

Thanks for your reply. But in my case, person does not have any document except what I mentioned in my query. Now what will be the possible solution?

then put the details of passport in din , further when ever he has address of india along with pan u can modify the details through din 4

But then it will not validate the form in the absence of PAN.

dont put citizen of india

validate it with foreign national 

paasport and aneexure 1 is sufficient


thereafter once u have indian address along with pan modify it through din 4

Good morning,

I believe that the DIN 1 can be applied as foreign citizen in this case as he has no other proof of Indian nationality and he has passport with outside India address.

Dear Pankaj,

there is only two ways:

either if ur citizen of india, : u must have pan no (manadtory for din) and address proof
for address proof u can visit and gazetted officer near by you and get certified that the person adress is ...........
(however pan will still be a problem.

with the gazetted office address proof u can apply for pan


now second and easiest way is go with foreign national address and file din 1 
and change it thereafter .


it now depends on ur urgency which way suits to u

Thanks. I agree with you.

But can be apply by stating NO to the column CITIZEN OF INDIA-YES or NO, knowing and even giving passport containing Nationality as Indian?

if u want u can go in this way also : present address c: foreighn addres ( as this address proof is required)

and permanent address : as address of india


or simply put both address as foreign address it is completely ur choice

I think if u apply as a Foreign Citizen, u need Foreign passport and not Indian Passport. and these documents have to be Notarized by a Notary in the Foreign Country.

u need passoprt (whether indian or foreign) both is permissible

further if the person is india then u need not to get the notarized from foreign company

I agree to you to some extent BUT
Nationality is determined as per the information in Passport. In our case the nationality is Indian, then please inform how can be write citizen of India NO in form?

there are two question in din 1 form: 

a) whether he is ctizen of india : put no


b) nationality : put india 

and then try

Dear Priyanka,

Our main aim is not to get prescruitiny done only.

We want to apply for DIN within the rules and regulations and as per the documentary evidence attached with the form.

The solution suggested by you this time is most obvious but as per documentary evidence it will be wrong.

So to conclude our discussion-

1. Either we have to apply for PAN as you rightly suggested earlier

Or

2. Change in Nationality then apply for as a foreign national.

Then only it will be valid as per law.

Others views are highly appreciable.

u get my view point wrong,

issue is to put the thins correct in order .

i just suggested if u put nationalit as indian , whether the form is acceptable or not, if its acceptable, then ur problem get solved:


because u can put all the details in order .

he has address of foreign: this means he is not a citizen as per rules( in indai for 182 days and other)


nationality being india(as per passport)

and in such case pan no is not required 


so i said to pre scrutinized the form and check the details . whether it works or not

or else go for other options

Query is unique now-

While selecting : whether citizen of India- YES
                         Whether Resident of India - No

But further it shows to fill details only for indian addresses EVEN IN PRESENT RESIDENTIAL ADDRESS COLUMN which is not in India as applicant is NRI.

Please help to understand
