Company Secretary & Compliance Officer Resignation after appointment of IRP

Dear All

In case of a listed company, the company secretary and compliance officer have resigned before the appointment of IRP. However, the Form of resignation cannot be filed with ROC as IRP got appointed.

To the extent of my knowledge, the form can be filed as per law. As neither the form filing is barred nor any approval is required for filing form for resignation given by the company secretary and compliance officer.

Please confirm can this form for his resignation be filed with ROC without any delay or without seeking any approval from COC or any other authority.
