DIN Deactivation issue

Dear Professionals,

One of the Director DIN was deactivated from 01/11/2015 till 31/10/2020 due to non filing of Annual returns. However still the Company in which he is a Director has not filed any Annual Filings from 2011 till date. Whether can we appoint him in other Companies and make him as an active Director ?

No. If the DIN is deactivated due to non filing of KYC, then you can reactivate it by filing additional fees. However, if it's deactivated due to disqualification for not doing annual filings, then you cannot appoint him in other companies as a director as his DIN status will show his status as director in non-compliant company.

As the Company status is still showing Non-Compliant so he cannot be appointed as a Director.
