In our Company , we already have 2 MDs,1 WTD,CS and CFO before app. of 2013 Act.

All have been designated as KMP.My query is whether MR-1 is required to be filed for their app as KMP. the relevant sections & rules of the Form MR-1 talk of fresh appoitnemtns only.in case i file Form MR-1 for appointment of CFo from back date then penal fees will be levied.

MCA people say that lodge a complaint regarding this. i am waiting for a revert now.

its not lyk tht because for CFO appointment there is no form required to be filed in CA ,1956, so as per NCA,2013 its mandatory to file the DIR 12 for whom whose record not in ROC DATA for PUBLIC or Listed Co.
