Would request if anyone can answer my below questions related to Form DPT-3:

1. Is it mandatory to file Form DPT-3 by the companies incorporated during the FY 2020-21?
2. If yes, then if the company has not taken any deposits or advances as on 31.03.2021, then also is it mandatory?
3. How to report figures for newly incorporated companies, if the audit of the FY 2020-21 is not yet done.

Thanks & Regards,
Shubham Bindal

Can you please elaborate, since I couldn't find in the provisions/rules that DPT-3 is not mandatory for the new companies/ companies not having any deposits.

Thanks for your explanation.

As per my knowledge it is required if it's first FY ending on 31.03.2021.
For Data (Networth & exempted deposit amounts): feed data as on 31.03.2021 whether audited or unaudited.

And if there is no Loan & Borrowings or any other exempted deposit then there is no requirement to file Nil return.

For reference you can consider Explanation of Rule 16 of Acceptance of Deposit which says you have to report only return of deposit or transaction not considered as deposit i.e. there is no need if no any such amount is there as on 31.03.2021.

[Explanation.- It is hereby clarified that Form DPT-3 shall be used for filing return of deposit or particulars of transaction not considered as deposit or both by every company other than Government company.]
