Cancellation of charge

Dear Friends

                    My company is  facing a problem regarding form-8

Case------Company had created  charge on its assets for an Overdraft  from SBI . Now the company wanted to modify  charge for  increasing the overdraft limit. The bank got agreed for this and all formality was completed. But at the time of filing form-8 for modification of charge , wrong option got selected i.e. "Creation of Charge" in place of "Modification of charge" and the form was approved and a Charge ID got generated by ROC, and letter for creation of charge was sent to the company by ROC. 

                            Now the company is  having two Charge-IDs for  a single Borrowing. Company want to get the latter charge cancelled and Modify the previous Charge. What all I need to do?, and what will be the process? Please reply

u cn file an affidavit with CRF & Master data with the ROC explaining them the facts of the case for deletion of the said charge from the portal........

               Will I have to take any NOC from   the concerned Bank, and what does CRF stand for? and what all documents will be required for master data

No u dnt req any NOC frm the Bank... only the Change request form, the Affidavit and the copy of the Master data...

simple way is to file Form 17 for one of the charge ids with a No due
letter from the bank for that charge id

But I guess the Bank vl not agree givin a No due certificate as the aforesaid charge has been modified and never satisfied. But anyways if it agrees then good… try ur luck sameer!

             I am also thinking the same. I think Bank will tell us to complete lots of formality before giving No- dues certificate. Let me try this and see what happens

Its Madam and not Sir… neways, first of all my qstn is that y will bank give NOC for a charge which is not satisfied??? In cases where u got 2 dlete an already satisfied old charge of which f 17 is not available in ur records, banks considers givin NOC as on date for the same cos the charge is satisfied. But the charge which is not satisfied and jst modified, y will bank say that there are no dues existing against the aforesaid loan?? But then u need to take a call on this… all d best!!

My request at the outset.Pls when you write to an official forum do
not use chat language.

The bank can give a letter specifying the charge id which you want to
close...the words should be "We have no objection in the Company
closing the charge id...."
with this letter the earlier charge id can be closed since anyway a
new id has been created to show the banks charge
