condonation of delay in filing of Form ADT 2

The EForm ADT 2 for the removal of the statutory auditors before his term could be filed after 37 days (with a delay of 7 days delay) at the MCA portal. The filing fee was only ordinary filing fee and no extra/additional fees was charged while filing.
The Office of the Regional director is rejecting the form stating that the form is filed with delay and the power for the condonation of delay is not with them and is only with Central Government. Hence at this juncture what is the best course available to us since the extended AGM need to be held within 31-12-2016 by approving and adopting the audited accounts of the company.
