Query- Annual Filing Form 20B

Hello,

 

This is a query for Annual filing of Form 20B of a Private Limited Company wherein the Form 20B is to be filed for the year 2008 and the DIN of the Director whose DSC is to be used, is dated 15/04/2009. Therefore, the system is not accepting the Form. Only DSC of one Director is available.

 

Is there any way out?

 

Kindly advise.

Dear Madam,

 

In your query, you have mentioned DIN of the Director is dated 15/04/09. Whether it is a date of appointment of director or date of obtaining the DIN.

 

If it is the date of appointment, then you cannot use his DSC for the filing of AR of 2008.

 

If it is the date of obtaining DIN, then system must take his DSC provided you have filed DIN 3 or Form 32 as the case may be.

Dear Sir,

 

It is the date of obtaining DIN and DIN 3 is also filed. Yet system says that Annual Return is dated 30.09.08 & DIN of Director is dated 15.04.2009. Therefore not acceptable.

 

Kindly advise as DSC of the other Director is not available.

Dear Madam,

 

Sorry, I agree with Mr.Rao. For using DSC of a director only 2 conditions are to be satisfied:

 

1. His DIN 3 or Form 32 must have been filed and registered

2. DSC must have been registered against his DIN in the MCA Portal.

 

As Mr.Vivek Says, it may be due to MCA's technical  problem.
