urgent - stamp paper expiry

Dear friends 

I have to execute an agreement today but i have 2years old stamp paper, can i execute the agreement on the stamp paper.

Is there any limitation period mention the expiry or stamp paper becoming stale.

If you are govern by Indian Stamp Act then you can do it. there is no such impediment under the Act. IThere is a supreme court judgement in this regard which is attached herewith (relevant portions highlighted in yellow). If your state has a separate legislation in force pls. check that.

In maharshtra stamp papers older than 6 months are not valid as per Bombay Stamp Act. Refer your state stamp act.
 
Section 52B of The Bombay Stamp Act, 1958 as applicable in state of Maharashtra is as follows

[52B. Invalidation of stamps and saving

Notwithstanding anything contained in sections 47, 50, 51 and 52,-

(a) Any stamps which have been purchased but have not been used or in respect of which

no allowance has been claimed on or before the day immediately preceding the date of

commencement of the Bombay Stamp (Amendment) Act, 1989 (hereinafter referred to as

"the commencement date") and the period of six months from the date of purchase of

such stamps has not elapsed before the commencement date, may be used be fore a period

of six months from the date of purchase of such stamps is completed, or delivered for

claiming the allowance under the relevant provision of this Act; and any stamps not so

used or so delivered within the period aforesaid shall be rendered invalid.

(b) Any stamps which have been purchased on or after the commencement date but have

not been used, or no allowance has been claimed in respect thereof, within a period of six

months from the date of purchase thereof, shall be rendered invalid]

thx for your suggestions, but case is refred to uttar pradesh. is there any judgement or any thing mentioned in the stamp act of Uttar Pradesh.

In U.P Indian stamp act is applicable and the judgment i sent stands valid

The forum has already discussed in length about stamp paper issue and we concluded that as per Indian Stamp Act that stamp paper once purchased can be used any time.  The six months period is only for refund of unused stamp paper. ( in good condition)
