Hi Everyone,

1. Can anyone tell me whether there is any stamp duty on shareholder agreement in Maharashtra?
2. In case of incorporation, if stamp duty of subscribed shares is more than Rs. 5,000/-, only E-SBTR is sufficient? or share certificate is required to be franked? (in Maharashtra)

My replies in line are as follows:

1. Can anyone tell me whether there is any stamp duty on shareholder agreement in Maharashtra? - Yes you need to enter it on a stamp paper of ₹100/- & notarise it.
2. In case of incorporation, if stamp duty of subscribed shares is more than Rs. 5,000/-, only E-SBTR is sufficient? or share certificate is required to be franked? (in Maharashtra) - Yes on share certificates, the same has to be franked via E-SBTR if it's more than ₹5,000/-

I have read somewhere about stamp duty on shareholder agreement is calculated in percentage of total share capital.

okay only E-SBTR receipt is sufficient and same has to be attached with share certificate right?
