removal of charge from MCA portal

Dear Members,

In one of our private Company, the charge was created in favour of seven banks during 1985 and all the charge was satisfied in 1990. But the Company yet has not filed Form 17 with ROC and hence showing as standing charge on MCA portal. We approached to the Bank for issue of NOC at current date but due to their management change they are not agree to give NOC. And one more thing out of the seven bank, one bank has already wind up in the year 1996.

You are requested to kindly give your valuable suggestions to how we can remove the charge from MCA portal. Your responce will be highly appreciate.

Dear Manthosh,

 

Your Company can show the Audited Balance sheet (which wouldnt have the said amount as dues) and can co ordinate with the bank to get a certificate showing that the charges were satisfied.

 

If the banks refuse to give NOC, may be, you can seek for a certificate of satisfaction of charges (current dated, stating the date of satisfaction), instead of NOC which would merely NO DUE as on date.

You may seek help from MCA Help Desk for the charge with the Bank which was Wound up.

I also have a situation where the bank has been merged into another bank (Allahabad Bank to Indian Bank). What may be done

Please obtain letter from the existing Bank stating that charge number in favour of merged bank, stands closed.   Then file satisfaction of charge form.

Write an application with all banks mentioning details and requesting for NoC and also to sign relevant e form;

make an application with ROC along with financials mentioning status with copy of letters as written and request for removal of charges through back end with payment of fees as ordered
