SICA, 1985

Dear Members,

Request you to appraise whether the Sick Industrial Companies (Special
Provisions) Repeal Act, 2003 has been enforced repealing the SICA,
1985?

SICA 1985 is still not repealed. Effective date of the Sick Industrial Companies (Special Provisions) Repeal Act, 2003 is not yet notified in the Official Gazette.

On the other hand, in the Companies Act 1956 Part VIA-'Revival and Rehabilitation of Sick Industrial Companies' is included vide the Companies (Second Amendment) Act 2002 but effective date yet to be notified.

Until effective date of Part VIA in the Companies Act 1956 and SICA Repeal Act is notified, SICA 1985 continues. BIFR is still functioning and all provisions of SICA 1985 to be complied.
