BACK DATED RENT AGREEMENT - VALID OR NOT ?

please let me know that can we execute rent agreement today for the previous year i.e. from 01.04.2014 - 31.03.2015 and would it be valid as per the act applicable ??

Hello,

There is nothing like back dated agreement, however by inserting clause in your agreement for 'date of application of agreement' you can give it a retrospective effect.

Can u also tell me what is the amount of stamp duty to be paid on the rent agreement ?? 

Under schedule 1 of Indian stamp act 1899 , under which heading it is covered ??

Hi,

Back dated agreement may b entered into if stamp paper of earlier period is possible to be obtained . 

Else alternatively,You may enter into an agreement say as on today. but ensure your stamp paper is dated prior to the date of execution.

Also mention in the  Duration clause that "the agreement including  the annexure/schedule to the agreement  is w.e.f _______2014 to _________2015.

You would need a stamp paper of last year for executing the agreement. In case you do not have the stamp paper u eould need to get the agreement adjudicated as though the agreement was executed but stamp duty was not paid.

Yes. It has to be paid on every agreement unless the stamp law of the  state specifically exempts such instrument from stamp duty.
