Auditor is been removed by the company and new auditor is to be appointed. Is there a time span within which that resigning auditor need to provide No objection Certificate to New to be appointed auditor.??

Dear Member,

There is no such provision in the act where the Auditor has to give a NOC for his removal to the Company. If the auditor agrees for his removal then the best option is, the auditor tender his resignation to the Company and file form ADT-3 with ROC within a period of 30 days from the date of resignation. The Company will appoint another auditor in a Board Meeting while following the detailed procedure subject to the approval of such appointment in an EGM to be held within a period of 3 months from the date of Board Meeting. The Company will also file form ADT-1 for such appointment within a period of 15 days from the date of Board Meeting. The resignation from the auditor option is adopted for the reason of avoiding the detailed procedure to be taken for removal of auditor by the company.
