Incorrect Selection in SPICe+ Part A for Section 8 Company

Dear Members,

I have filed the SPICe+ Part A form for incorporating a Section 8 company. However, by mistake, I selected the option for “Company Limited by Guarantee” instead of “Company Limited by Shares.” The name has already been approved by the MCA under this incorrect category.

Kindly guide me on the appropriate course of action. Should I withdraw the approved name and apply again under the correct category, or is there any other remedy available in this case?

OPTION AVAILABLE is to  "ALLOW THE NAME TO EXPIRE" and make  a fresh straightline-incorporation (without reserving the name)

Also attach NOC from the applicant who made the application for guarantee company as an abundant caution, though it may not be required

Thank you for the reply. But can I send the Email to the MCA with an affidavit to change the status from limited by guarantee to limited by share?

sending an affidavit to MCA may not help. 

Instead, Start a new spice form for incorporation and attach the affidavit with the form. That will go though
