Dear All,

One of my LLP registered 3 months ago. They want to change the LLP agreement so should I have to pay stamp duty again ? 

please advise .

Contribution is 1 lac (1000 stamp duty)

Yes, Supplementary deed also has to be executed on Stamp paper.

In Maharashtra, Supplementary deed has to be on stamp paper / ESBTR of Rs 500 if there is no change in contribution

If there is an increase in contribution, then 1% of increase in contribution (rounded up to the next Rs 100 as a matter of caution)

If Professionals are present as witness to the Supplementary Deed, then no need for notary.

I do not have any reference point. This was a practice which was advised by a senior professional to us to avoid any query with respect to witness.
But later we were informed that if CS / CMA / CA  members sign as witnesses, then notary not required. Of course I have across agreements which are not notarized or witnessed by professionals, and are approved by ROC office.
